Terms & Refund Policy

Effective date: October 6, 2026

These terms explain how buying from Nishan Consultancy works. We are a service consultancy, so most of this page is about service work: PMS + website audits, monthly PMS support, website packages and website maintenance. Our digital e-books are covered in a short section near the end. If anything is unclear, email us at info@nishanconsultancy.com before you buy.

Who we are

Nishan Consultancy (“we”, “us”) is run by Md Nishan Amin and backed by Hospai Technologies, Kamloops, British Columbia, Canada. We work remotely with independent hotels in the United States and Canada. “You” means the person or business buying from us.

Our services

The services below are sold through the cart on this website. Full details are on our Services page.

• Free PMS + Website Audit: free until November 30, 2026 (regularly $200, one-time). You get a written report and a 30-minute findings call. Turnaround is 3 business days after you grant us access to your PMS. The audit does not include implementing fixes.
• Monthly PMS support retainers: Starter $300/month (up to 5 hours), Growth $550/month (up to 10 hours) and Full Partner $950/month (up to 18 hours).
• Website packages: Small Property Site $800 to $1,200 (about 2 to 3 weeks) and Custom Booking-Focused Site $1,800 to $3,000 (about 4 to 6 weeks). The final price depends on the features you select.
• Website maintenance: $150/month for up to 3 hours of edits per month.
• Other services and custom offers: PMS setup or rescue, PMS migration, guest messaging (Whistle) setup and private custom offers are quoted individually.

Ordering, intake and scope

• Before checkout, you complete a short project intake form. This is required for every service.
• The scope of your service is what is described on our Services page or in your quote, together with your answers on the intake form.
• Anything outside that scope is a change request. We will quote it separately, and we only start it after you agree.

Payment

• Payments are taken at checkout and processed securely by Stripe.
• Website packages are paid 100% upfront at checkout.
• Monthly PMS support retainers and website maintenance are paid monthly in advance.

Monthly PMS support retainers

• Retainer hours are active working hours. They are not a response-time guarantee.
• We notify you when you have used 80% of your monthly hours.
• Extra hours beyond your plan are billed at $50/hour. Urgent issues are fixed immediately, even if you are over your hours, and the overage is billed afterwards.
• Unused hours do not roll over to the next month.
• Retainers are month-to-month. You can cancel with 14 days’ written notice.

Website packages

• Timelines depend on you providing content, brand assets and access on time. Late content or access moves the timeline.
• Each package includes 2 rounds of revisions. Extra changes are quoted separately.
• When the project is complete, the finished website transfers fully to you.
• If you do not respond for 30 days or more, we may close the project and treat it as delivered for the work completed.

Website maintenance

Website maintenance is $150/month and covers up to 3 hours of edits per month. Extra time is billed at $60/hour. It is month-to-month, and you can cancel with 14 days’ written notice.

Third-party costs

Third-party costs are your responsibility and are not included in our prices unless we say so in writing. This includes PMS subscriptions, booking engines, domains, hosting, plugins and OTA fees.

Refund policy

We want refunds to be fair to both sides. Service work takes time that cannot be given back, so refunds depend on how far the work has gone.

Website packages (paid 100% upfront)

• Within 48 hours of payment and before the kickoff (discovery) call: full refund.
• After kickoff but before you approve the design: we refund the amount you paid minus work completed (billed at $50/hour) and any third-party costs already incurred for your project.
• After the design is approved and the build has started, or after launch: no refund.

Monthly PMS support retainers and website maintenance

• These are paid in advance and there are no refunds for partial months.
• To cancel, give us 14 days’ written notice. Cancellation takes effect at the end of the notice period.
• If we cannot deliver the agreed service in a month, we will credit or refund the unused portion.

PMS + Website Audit

• The audit is free until November 30, 2026. Because there is no charge, no refund applies.
• If you buy a paid audit after November 30, 2026, you get a full refund if you cancel before you grant PMS access and work begins.

Custom offers

Refunds follow the terms stated in your custom quote. If the quote does not cover refunds, the website-package rules above apply.

E-books

E-books are digital downloads, so they cannot be refunded once downloaded. If the file is defective or not as described, contact us within 14 days of purchase and we will send a replacement or refund you.

How to request a refund

• Email info@nishanconsultancy.com with your order number and a short reason.
• We review every request within 5 business days.
• Approved refunds go back to your original payment method through Stripe and usually arrive within 5 to 10 business days.

Chargebacks

If you have a problem with a charge, please contact us first. Most issues can be sorted out quickly by email, and it is faster for you than a bank dispute.

Digital e-books

Our e-books are $12 PDF downloads, available right after payment. They are for your own use and your property’s team. Please do not resell, share publicly or republish them. Refunds for e-books are covered in the refund policy above.

Your responsibilities

• Give us timely access to the systems we need for the agreed work, such as your PMS or hosting.
• Give us accurate, complete information about your property and your project.
• Keep backups of your own data where applicable, for example before PMS changes or migrations.

Access and confidentiality

• We use your logins and credentials only for the agreed work.
• You can revoke our access at any time.
• We recommend creating a dedicated user account for us rather than sharing your own login.

Intellectual property

• After full payment, you own the final website deliverables we create for you.
• We may reuse our general know-how, methods and templates in other work.
• We may list your project in our portfolio unless you tell us you would prefer we do not.

No guaranteed results

We work hard to improve your systems and website, but we do not guarantee specific results, search rankings, bookings or revenue.

Limitation of liability

• Our total liability for any claim is limited to the amount you paid us for the specific service involved in the 3 months before the claim.
• We are not liable for outages, errors or changes on third-party platforms we do not control, such as your PMS, OTAs or booking engine.

Governing law

These terms are governed by the laws of the Province of British Columbia, Canada.

Changes to these terms

We may update these terms from time to time. The effective date at the top shows when they last changed. The version in effect when you place an order applies to that order.
